Upon purchase, the risk of the object of sale shall transfer to the winning bidder.
In the event of a legal dispute, regardless of reason or cause, the parties agree that the court with jurisdiction over the seller's current address shall be the exclusive court of first instance, and by bidding, the bidder agrees to bring legal action in said court. The exclusive jurisdiction agreement shall apply even to matters outside of this transaction.
If litigation is to be heard in a court other than the one with jurisdiction over the seller's current address, the winning bidder shall be obligated to withdraw the lawsuit and waive the rights related to the subject matter of the lawsuit.
In disputes arising from this transaction, the maximum amount of damages the winning bidder can claim, regardless of whether the claim is for breach of contract or tort, shall be limited to the total of the winning bid amount and shipping costs.
The winning bidder shall bear the costs of restoration to the original condition due to cancellation, and any other similar fees.
If pursuing the seller's liability, the winning bidder shall bear the burden of proof for any claim and must provide evidence that leaves no room for reasonable doubt.
The winning bidder shall bear all responsibility for any issues inherent in transactions between parties, regardless of where responsibility lies.
If a refund or other monetary transaction becomes necessary due to any circumstances arising from this agreement, such transactions shall be conducted between accounts at a bank designated by the seller, regardless of the seller's fault.
If, for any reason, the winning bidder needs to ship an item to the seller, the seller shall choose the shipping method, regardless of the seller's fault in the circumstances that led to the need for shipping.
If, for any reason, the winning bidder needs to ship an item to the seller, and the seller is at fault for the circumstances that led to the need for shipping, the seller shall be deemed to have fulfilled their obligation by paying only the shipping costs to the winning bidder. The seller shall not incur any claims from the winning bidder for other actions necessary for shipping, such as packing and shipping, related to the winning bidder's shipment. #きーろ
